Manchester woman awarded over £15,000 after her boss told her to flirt with customers

Kinga Zborowska, a sales manager, has won more than £15,000 in compensation after her boss allegedly instructed her to use her ‘women’s assets’ to ‘flirt’ with customers to generate more business.

The employment tribunal heard that Ms. Zborowska felt humiliated and degraded when the managing director of recruitment agency P&M Resources, Adam Peruta, made repeated comments about her appearance and suggested that using her femininity was the best way to get a client’s attention.

In addition, she claimed that Mr. Peruta had repeatedly asked her to include a photograph on emails she sent to customers and had made inappropriate comments about her medication during a video call, leaving her feeling scared and shocked.

After going off work sick, Ms. Zborowska was fired from the job she had held for just 52 days. She sued the company for the way in which she had been treated and won her case for sex harassment, disability harassment, and disability discrimination, as well as additional claims for unpaid holiday pay and failure to provide her with a written statement of her working conditions. However, her claims of sex discrimination regarding the email photo request and victimisation were dismissed.

During the tribunal, Ms. Zborowska’s evidence was accepted that she was disabled as a result of her anxiety, and the tribunal found that Mr. Peruta had humiliated her and caused her to feel like a ‘sex object.’

The tribunal also concluded that the MD’s conduct had created a harassing environment and reached the level of being disability-related harassment.

The award Ms. Zborowska received was based on the harassment she suffered, including the trauma she experienced because of Mr. Peruta’s conduct.
