High Court Battle Over Damaged Property

Property Developer’s Appeal Kam Babaee, a wealthy TV property developer, has initiated a High Court appeal against a substantial £740,000 payment awarded to celebrity nail artist Leighton Denny. The legal dispute stems from the sale of a £1.2 million newly-built home in Chiswick, London, in 2015. Babaee’s company, K10 Developments, sold the property to Denny, known for serving clients like Kate Moss and Adele. However, the house soon encountered significant damp issues, prompting Denny to file a claim against Babaee and K10 in July 2019.

Luxury Property Developer in Legal Battle

Background of Kam Babaee Kam Babaee, originally from Iran and featured on TV shows like Channel 4’s “Britain’s Most Expensive Houses,” is renowned for his involvement in luxury property developments. The dispute revolves around this newly-built Chiswick house, constructed on land owned by Babaee, previously a site for a Ferrari showroom, which suffered water damage shortly after the purchase.

Legal Award and Subsequent Appeal

s

Outcome and Appeal In April of the following year, a court awarded Leighton Denny £549,773.90 in damages for the damp issue, along with £180,000 in costs. Notably, the claim against the house’s builders, Connor Construction, was dropped. Now, Kam Babaee has launched an appeal, disputing responsibility for the defects. He alleges that the faults arose due to flaws in the damp proof membrane system.

Counterclaim and Perspectives

Response from Kam Babaee and Leighton Denny Babaee has additionally filed a counterclaim against Leighton Denny, asserting that Denny undertook insufficient remedial work on the property before initiating the legal action. Babaee contends that K10 Developments was not involved in the house’s construction or design and that it was built by Connor Construction, with oversight from independent architects and project management.

Voices from the Involved Parties

Babaee’s Perspective Kam Babaee expressed his frustration, calling the award “obscene” and maintaining that his company had been wrongly implicated in the case.

Denny’s Response Leighton Denny, whose nail care products are carried by retailers like Marks & Spencer and John Lewis, affirmed that the litigation had been resolved in his favor. He is actively pursuing enforcement of the court-ordered debt owed by Babaee.

Builder’s Standpoint Connor Construction, the builder of the disputed property, has not yet provided a public comment on the matter.

This legal dispute underscores the complexities and disagreements that can arise in high-value property transactions, particularly when issues such as structural defects emerge after the sale.
