Dr. Nandipha Magudumana Files an Urgent Application
Celebrity doctor Nandipha Magudumana, who was arrested in Tanzania alongside her partner and convicted criminal Thabo Bester in April, has filed an urgent application in the Bloemfontein High Court.
She seeks to have her arrest and subsequent deportation declared as wrongful and unlawful, as well as to overturn the ongoing criminal proceedings against her in the Bloemfontein Magistrate’s Court.
Furthermore, Magudumana wishes to be discharged from the custody of the Department of Correctional Services (DCS).
Legal Analyst Weighs In
Legal analyst Mpumelelo Zikalala expressed skepticism regarding Magudumana’s chances of success in her application.
Zikalala emphasized that there are alternative remedies available and a proper process to address her concerns.
He acknowledged the infringement of rights that may have occurred but noted that there may be valid explanations for such actions.
Zikalala pointed out that Magudumana had the opportunity to protect her rights by applying for bail, yet she chose not to do so.
He highlighted that the urgency of the matter alone would not suffice for the court to consider her application.
Magudumana’s Previous Court Appearance and Upcoming Hearing
During her appearance at the Bloemfontein Magistrate’s Court on May 11, Magudumana decided against applying for bail due to emerging crucial evidence.
She and the other accused are scheduled to return to court on June 20.
The urgent application will be heard in the Bloemfontein High Court on May 25.
