Dr Nandipha Magudumana, the girlfriend of escaped serial rapist Thabo Bester, has taken legal action by filing an urgent application in the Bloemfontein High Court to declare her arrest as “wrongful and unlawful.”

In her application, Magudumana aims to have her apprehension, arrest, and abduction in Arusha, Tanzania on April 7, as well as her transportation to South Africa, declared null and void.

She also requests the court to set aside the ongoing criminal proceedings against her in the Bloemfontein Magistrate’s Court and seeks to be released from the custody of the Department of Correctional Services (DCS).

Accused of Aiding Prison Escape

Magudumana, who was arrested in Tanzania alongside Bester, is one of the eight individuals accused by the State of aiding and abetting the prison escape.

Presently, she is detained in Kroonstad.

Delay in Bail Application Due to Crucial Evidence

During the bail application hearing on May 11, Magudumana’s lawyer stated that she would not apply for bail at that time due to the emergence of crucial evidence.

The lawyer also mentioned that Magudumana is exploring alternative avenues to protect her rights, indicating the possibility of pursuing other legal processes outside the current court proceedings.

High Court Hearing and Next Court Date

The urgent application will be heard in the Bloemfontein High Court on May 25.
