Jessica Smith, the fiancée of Stephen Bear, could face imprisonment after she filmed herself on TikTok during a visit to HMP Chelmsford, where Bear is serving a 21-month jail term.
Bear was convicted of two counts of disclosing private sexual photographs and films with the intent to cause distress and two counts of voyeurism.
He was put on the Sex Offenders Register for ten years and given a five-year restraining order that told him not to contact Georgia Harrison, his victim.
Despite this, Smith booked a time to see him in prison and filmed herself with Bear in a TikTok clip, saying, “Come with me on a visit to see my boyfriend.”
The 1952 Prison Act decrees that it is an offence to take a photograph or make a sound-recording inside a prison, or transmit any image from inside a prison by electronic communications for simultaneous reception outside the prison.
If a person is found guilty of this offence, they could face conviction on indictment, imprisonment for a term not exceeding two years, or a fine (or both).
After the visit, Smith wrote on social media that she would marry Bear in 2024. Bear proposed to Smith at the Moulin Rouge in Paris before he was sentenced.
At sentencing, Judge Christopher Morgan said that a jail term was “only appropriate,” as Bear “deliberately lied” to “exploit the economic value” of the tape.
Bear’s victim, Georgia Harrison, had appeared on The Only Way Is Essex, Love Island, and Olivia Meets Her Match.
She was unaware she had been secretly filmed and begged Bear not to share the footage when he showed it to her.
Yet, Bear ignored her desperate pleas and went on to share the intimate footage on WhatsApp and the online subscription site.
After Bear’s conviction, Harrison accused the reality star of “hanging her on the wall for millions to see” and called the last two years “absolute hell.”
She waived her right to legal anonymity to speak out and encouraged others to seek justice.
Bear’s Twitter account posted a “50% off” deal for his adult entertainment website alongside a photo of him arriving at court while he was on trial.
During the trial, a photo of him walking from a hired chauffeur-driven white Rolls Royce to the court building was uploaded to his Twitter account.
In conclusion, filming inside a prison is an offence punishable by imprisonment or a fine, and Jessica Smith’s TikTok clip of her visit to Stephen Bear could result in jail time for her.
Bear was convicted of serious crimes, including voyeurism and disclosing private sexual photographs and films with the intent to cause distress, and his victim, Georgia Harrison, spoke out publicly after his conviction to encourage other victims of revenge porn to seek justice.
