Chairperson of the State Capture Commission Raymond Zondo has recommended that former minister Malusi Gigaba and others be charged with corruption and racketeering.
The second instalment of the State Capture Commission’s report, which focuses on looting at Transnet and Denel, was handed to the Presidency’s Director-General Phindile Baleni on Tuesday, 1 February 2022.

Gigaba along with Transnet’s former Group CEOs Brian Molefe and Siyabonga Gama, former CFOs Anoj Sign and Garry Pita and former chief procurement officer Thamsanqa Jiyane, are considered central figures in corruption at the freight agency.
They’re all accused of making certain decisions which often favoured the Gupta family’s business interests.
According to the report, the executives and Gigaba allegedly accepted cash payments and gratification from the Guptas between 2010 and 2018. Molefe, on the other hand, admitted to having carried bags of cash, but claimed the money was for a burial society of which he was the treasurer.
“Three witnesses testified to the commission, essentially to the effect that Mr Molefe, Mr Singh, Mr Gama and Mr Gigaba were recipients of cash bribes from the Gupta enterprise. All three were drivers and close protection officers to these officials,”

An unidentified witness, who was a driver for Gigaba, testified to having driven him to the Gupta’s Saxonwold home at least seven times and each time he would come out with a bag full of cash.
“It is recommended that law-enforcement agencies conduct such further investigations as may be necessary with a view to the possible prosecution of Mr Molefe, Mr Singh, Mr Gigaba, Mr Gama, Mr Pita and Mr Jiyane on charges of corruption and racketeering in relation to cash payments allegedly received by them during visits to the Gupta compound during the period of 2010-2018.”
