In fact, last Saturday’s unprovoked assault occurred just one week after similar security film showed the moment 55-year-old Bui Van Phu wore gloves and viciously punched 52-year-old Jesus Cortes in the back of the head.
Cortes slumped to the ground and appeared unconscious after striking his head on the concrete. On August 12, EMS rushed him to NYC Health + Hospitals/Jacobi after he sustained a skull fracture, a shattered cheekbone, and bleeding in the brain.
An early investigation revealed that Cortes exited the restaurant, paused, and witnessed numerous individuals conversing before a man exited the restaurant, donned gloves, and positioned himself behind the victim.
An NYPD spokeswoman stated, “Without any prior interaction or dispute, the suspect hit the victim in the face before returning to the restaurant and then fleeing to an unknown location.”
After the altercation, authorities say Cortes was in critical but stable condition, but he has since undergone brain surgery and was recently taken off a ventilator.

The District Attorney lowered Phu’s charges from attempted murder to misdemeanors after the initial arrest on suspicion of attempted murder. When the attack occurred, he was on parole.
At his hearing, his parole officer, Nixa Rivera, stated, ‘Mr. Bui is a 55-year-old male with a history of repeat violent criminal convictions.
Mr. Bui is a level three sexual offender, which is the highest classification on the sexual offender registry. Mr. Bui remains an imminent danger to the community.
Rivera stated that Bui has lived in a shelter for the past six years and has no obvious family or community links.
His only job for the past two years has been operating the cash register at a nail salon.
The Legal Aid Society counsel assigned to Bui, Alison Lowy, stated that public pressure should not have increased the severity of his accusations.
She continued, “When this incident occurred, the defendant called his parole officer, who instructed him to surrender, which he did.”
Despite this, Rivera stated that his charges are likely to be upgraded to felonies.
